Clarification Text for Website Visitors

KUZEY BORU ANONİM ŞİRKETİ ("Kuzeyboru"), as the data controller, processes your personal data in accordance with the Law No. 6698 on the Protection of Personal Data (KVKK) and other applicable legislation.

According to Article 10 of the KVKK, which regulates the obligation to inform, data controllers are required to inform individuals whose personal data they process about certain matters.

This clarification text has been prepared in accordance with the "Procedures and Principles to be Followed in Fulfilling the Obligation to Inform," as published by the Personal Data Protection Authority, to fulfill the legal obligation.

Definitions

According to the Law No. 6698 on the Protection of Personal Data:

Personal data refers to any information related to an identified or identifiable natural person;Processing of personal data refers to any operation performed on personal data, such as collection, recording, storage, preservation, modification, rearrangement, disclosure, transmission, transfer, acquisition, making available, classification, or preventing its use, whether by automated means or by non-automated means as part of a data recording system;Data subject refers to the natural person whose personal data is processed;Data controller refers to the natural or legal person who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data filing system;Obligation to inform refers to the obligation of the data controller or the person authorized by the controller to inform the data subject about the identity of the data controller, the purposes of processing personal data, the parties to whom personal data may be transferred and for what purpose, the method and legal basis of data collection, and other rights under Article 11 of the Law.

Data Subject

You, whose personal data is processed by Kuzeyboru, are defined as a Website Visitor due to your visit to our website at www.kuzeyboru.com, and you are considered a Data Subject under the Law.

Data Controller

Kuzeyboru, as the data controller, determines the purposes and means of processing your personal data, and is responsible for the establishment and management of the data filing system.

Purposes and Legal Grounds for Processing Your Personal Data

For tracking requests and complaints, storing, and archiving activities

-In accordance with Article 5/2f of the KVKK, and provided that it does not harm the fundamental rights and freedoms of the data subject, personal data will be stored based on the legitimate interests of the data controller.

Additionally, cookies are used to remember your language preference on the website and to enhance your user experience while using our website, extensions, applications, or other similar online and offline platforms provided by us, for the legitimate interest of the data controller.

Moreover, personal data indirectly obtained from various channels, such as websites, blogs, competitions, surveys, games, campaigns, social media (Facebook, Twitter, Google, Instagram, Snapchat, etc.), public databases, and shared profiles and data from social media platforms, may be processed and collected.

Transfer of Your Personal Data

Your personal data may be transferred to relevant authorities without the obligation of clarification and without your explicit consent, within the scope of Article 28/1 of the KVKK, if requested.

In unforeseen circumstances, your personal data may be transferred to public institutions (ministries, presidential councils, etc.) in accordance with the purposes and limitations specified by law.

Your personal data is not transferred to any institution, person, or organization outside of our legal obligations, and without requiring clarification or your explicit consent.

 

 

Your Rights Regarding Your Personal Data

As per Article 14 of the KVKK, data subjects must first apply to the data controller to exercise their rights regarding personal data. According to the Law, direct complaints to the Personal Data Protection Board are not allowed.

Under the Law, regarding your personal data, you have the right to:

Learn whether your personal data is processed,Request information if your personal data has been processed,Learn the purpose of processing your personal data and whether it is used in accordance with its purpose,Know the third parties to whom your personal data is transferred, domestically or internationally,Request the correction of personal data if it is incomplete or inaccurate,Request the deletion or destruction of personal data if the reasons for processing no longer exist,Request that corrections, deletions, or destructions made in your personal data be notified to third parties to whom the data has been transferred,Object to the processing of your personal data through automated systems, which leads to results that affect you negatively,Request compensation for damages caused by unlawful processing of your personal data.

How to Apply to the Data Controller

You can submit your request:

In your request, it is mandatory to include:

Your name, surname, and if your request is in writing, your signature,Your Turkish ID number (for Turkish citizens) or nationality, passport number, or identification number (if a foreigner),Your address for notifications or workplace address,Your email address, phone, and fax number (if applicable),The subject of your request,If applicable, any information or documents related to your request.

Your request will be concluded within thirty days. You will be informed about the result, which may be either (i) acceptance of your request with relevant information or (ii) a rejection with a stated justification.
